HERE TO HELP

The Divorce Process – Simplified

Deciding to move forward with a divorce is a significant moment in the lives of Richmond families. When you consult a divorce lawyer in London, you want them to make the process easier to understand so you can proceed with confidence.

At Skylark Hill, our divorce solicitors will help you get started with an application for divorce. You must first prove that you are eligible for divorce by showing that you have been married for 1 year or more and that your relationship has broken down permanently. The 2022 addition of no-fault divorces in England and Wales has simplified this process. You will need contact details for your spouse and your marriage certificate too.

You will either submit a joint application with your spouse or a sole application if you are applying alone. You will then pay the court fee. With a sole application, your spouse will receive divorce papers and have 14 days to respond. A mandatory 20-week reflection period will follow, during which time you and your partner can consider how you will proceed.

After the reflection period, you will apply for a Conditional Order to finalise your divorce. Normally, a divorce takes between 6 and 12 months to complete, but this can be longer if there are complicated financial settlements or child custody arrangements to make.

Common Issues Handled in Divorce Cases

When families in Richmond find themselves managing a divorce, they can be faced with a great many legal issues that are as complex as they are emotionally draining. One of the most common issues couples face is coming to an agreeable financial settlement. At Skylark Hill, our solicitors work to prioritise negotiations that help couples resolve these financial issues amicably without going to court. We are experienced in delivering results in divorces involving complex asset division, pensions, business interests, and debts. We always work to help you reach an equitable settlement that considers the interests of everyone involved.

Making arrangements for children can also become a challenge for couples facing divorce. Parents must create a parenting plan that addresses living arrangements, visitation rights and responsibilities, and financial support so their children remain adequately cared for after the marriage ends. The Skylark Hill family law team has worked for years with Richmond families to come to agreements that prioritise stability and the well-being of every child.

Sadly, some families must also navigate domestic abuse. Our compassionate and skilled solicitors have worked closely with clients who are facing domestic abuse and understand the importance of timely and knowledgeable care when helping families cut ties and move on following domestic violence. At Skylark Hill, we are committed to providing the best legal guidance and support for families and individuals facing this reality.

Frequently Asked Questions

Do I need a lawyer to file for divorce?
At Skylark Hill, we always recommend that couples considering a divorce work alongside a solicitor to get the best results for their family. Solicitors can speed up the divorce process and help with the complexities of divorce from the application to coming to amicable agreements regarding finances or childcare.

How long does the divorce process take?
Divorces usually take 6 to 12 months on average to be completed, however, this will vary from case to case. You may need to go to court if you and your spouse cannot agree on financial settlements or arrangements for children. This will make the process last longer.

Can a divorce lawyer help with child custody arrangements?
Yes. At Skylark Hill, our divorce solicitors are experienced in helping couples make arrangements to ensure their children are looked after after a divorce. Speak to us today to discuss your options and find out how we can help you.
